Terms & Conditions

Acceptance of Terms and Conditions

When booking or by attending a swimming lesson/class with Gold Fins Swimming Limited, the client accepts and is expected to abide by these terms and conditions. Failure to follow terms and conditions, the client may be requested to cease lessons with Gold Fins lessons and a refund will not be eligible in these circumstances.

Gold Fins Swimming Limited will not be liable for any loss, damage or injury while parking, changing, transferring to the pool or on pool premises. Parents are responsible for and must supervise their children at all times on pool premises. Children are not Gold Fins Swimming Ltd's responsibility until Gold Fins Swimming staff takes them into their lesson into the pool. Any incident must be reported to Gold Fins Swimming Limited immediately. Clients must accept that there will be physical contact between teacher and their child in a professional manner at times.

Responsibility 

All  swimmers should bring their own goggles, swimming caps and towels each lesson. 

Swimmers should not eat for at least 1 hour prior to swimming. Swimmers should come swim ready as changing rooms are only available for swimmers after lessons. Parents should take their children to the toilet before the lesson as the teacher will not be able to stop the lesson and wait for them if they have to leave the pool to use the toilet. 

Please ensure long hair is tied up.Jewellery can be a hazard and should not be worn during swimming, including earrings. No make-up or body lotions to be used as these significantly deteriorate pool water quality. Appropriate swimwear should be worn at all times in the swimming pool and communal changing areas.

Swimmers are required to come at least 5 minutes before the lesson/class. Lesson/Classes at Gold Fins Swimming Limited will start promptly at the time stated on the website. If you are late to the lesson/class, unfortunately your session will not be extended.

Clients should keep the noise down a minimum whilst waiting for their class. Gold fins Swimming Limited reverses the right to ask a client that is disruptive or has disorderly behavior such as shouting, fighting, diving, running, jumping and throwing items to leave the class and a refund will not be given. During lessons, parents/guardians must not interrupt or communicate to the teacher or pupils or approach the poolside as it will distract pupils, unless it is a matter of health and safety. 

Swimmers should not wear spectacles in the water during a session to avoid injury. Swimming goggles including ophthalmic prescription lenses may be worn at the wearer’s own risk. Care of spectacles is the responsibility of the parent/guardian.

Food and alcoholic drinks are strictly forbidden in the pool building. Strictly no outdoor footwear or buggies are allowed at poolside.

Parents should remain onsite at the pool when their child/ren is/are swimming. Parents are responsible to help their children to get dressed after swimming and exit as soon as you can. 

All property left in the changing room or poolside are left at the owner’s own risk. Gold Fins Swimming Limited do not accept responsibility for any property stolen or damaged.

Refund policy: 

Unfortunately no refunds will be given under any circumstances once payment has been made for lessons/classes. Our No refund policy also applies in case of circumstances outside control of Gold Fins Swimming Limited such as Government lockdowns, anything related to Covid-19, adverse weather conditions and power interruption.

If a client is not able to attend lessons due to sickness or holiday, Gold Fins Swimming Limited will be unable to refund or freeze lessons.

​

Lesson Prices

Class/Courses dates are published on our website. Term dates can differ from different schools, so please check this carefully so you don’t miss a lesson. 

Bookings can only be confirmed once payment has been received. Your/Your child(ren)’s regular slot will be held to allow current clients to rebook. However if not paid by the payment deadline, which will be communicated in advance, your space will be at risk as the slot will be released and another client will be allowed to book the slot. Swimmers will not be allowed into the pool unless payment has been received in full. 

Clients can join part way through a term and will be required to pay only remaining lessons in the term on a pro rata basis.  

Gold Fins Swimming Limited reserves the right not to accept your booking and will not be obliged to provide you with a reason for not accepting the booking.

Lesson Changes

In the event of an instructor being absent for a group or private lesson, Gold Fins Swimming Limited is within its rights to change the instructor to make sure that the lesson is covered without notice, and no refunds will be given for lessons because of a change of instructor. Or, in the unlikely event of a ‘last-minute’ lesson time change or lesson cancelation due to an incident of sickness at the pool (child vomiting or defecating in the water for example) where the pool needs to be evacuated for hygiene reasons, we endeavour to notify the client via SMS and email as soon as possible. Gold Fins Swimming Limited will not reimburse any expenses caused by a customer failing to pick up these messages. Gold Fins Swimming Limited will always try to reschedule any lesson that has not been able to occur, and the client will always be notified of any changes as soon as possible.

Registration fees 

All new swimmers (and swimmers who have been a member of Gold Fins Swimming previously and wish to re-join) pay a registration fee of £10. This is a one-off fee.

Make up classes

Parents/Guardians agree that they must provide at least 24 hours notice prior to any missed or cancelled lesson, or else their lesson will be forfeited and swimmers will not be eligible for make up lessons.  Please understand that the 24 hour notice period is necessary for Gold Fins Swimming to be able to offer make up lessons to swimmers. Make up lessons cannot always be offered and is solely at the discretion of Gold Fins Swimming. Where eligible, swimmers are entitled to a maximum of two make-up lessons per term subject to availability.

Please note that if swimmers do not show up for a lesson without giving any notice, they will forfeit the lesson.

​

Termination of Membership (Applicable to Adult Keep Fit Sessions only)

 If you need to cancel your membership, you must notify us by giving us one month notice. Gold Fins Swimming Limited has the right to terminate the Member’s membership immediately if any of the terms and the conditions of this Agreement are violated. Refund will be calculated pro-rata with an administration fee of £10.

Cancellation by us

Classes may be cancelled at short notice if the pool is not fit for teaching purposes.

In the unfortunate event we have to cancel a lesson we will notify you as soon as possible via the method that we believe is most appropriate to ensure you have received the message in a timely manner.  We will endeavour to add an alternative date, offer to make up the lesson or provide a credit. No refunds will be offered.

If we determine that there is insufficient support for a course, we have the right to cancel, suspend or postpone the course before the date of the first lesson. We shall give you as much notice as possible of any such cancellation and we will provide you with a full refund of your course fee if no suitable alternative course is found. Our liability for any such cancellation shall be limited to this refund and we shall not be liable for any losses of any kind incurred by you because of such cancellation.

If you notify us that you are unable to attend the substitute lesson in advance of the date scheduled for the substitute lesson, then you will receive a credit for the cancelled lesson. This credit may be offset against your fees for a subsequent course. If you do not accept the substitute lesson or do not wish to re-enrol for a subsequent course, we are not obliged to provide a refund but may do this at our absolute discretion.

Please note that this course may be cancelled if there are insufficient enrolments. In the event of cancellation, a full refund will be issued or alternative course offered where possible.

Medical Conditions and Illness

Clients are required to disclose all medical and behavioral conditions to Gold Fins Swimming Limited prior to attending swimming classes, especially if possibly harmful or not to another person.  Gold Fins Swimming Ltd staff are not medically qualified to comment or advise on whether swimming is or isn’t advisable if your child has any existing medical conditions. All information received is treated in confidence and with sensitivity and Gold Fins Swimming Limited has the right to accept or refuse any clients to join in lessons/classes. Instructors should also inform the Gold Fins Swimming Limited of any medical conditions they may have which could impact on their teaching ability. If your child is asthmatic please ensure that their inhaler is taken on poolside with them.

Clients must never bring the child swimming if they have any illness such as an ear infection, diarrhoea, chicken pox, impetigo, conjunctivitis or merely a bad cold. They must wait until the doctor has given the all-clear before returning to classes.  In the instance of sickness and diarrhoea the child must have been clear of all symptoms for at least 48 hours before attending a lesson. Swimmers should not attend if they feel unwell or have Covid-19 symptoms or are required to self-isolate.

Keep Fit Adult Swimming session 

Adults need to know how to swim independently to sign up to this session. Gold Fins Swimming Limited will not be liable for any swimmers in the Keep Fit Adult Swimming session. Swimmers accept that the swimming lane assigned to them will be shared with other swimmers and therefore they should respect and be polite to other swimmers in the pool. Swimming teachers at Gold Fins Swimming Limited will not be coaching or providing swimming lessons to the swimmers in this session. 

Swimming programme will be tailored based on the type of stroke and intended lengths to be achieved which are up to the swimmers to select. Gold Fins Swimming does not guarantee fitness results but will encourage the swimmers to reach their goals.

Photography/Videography

Photography/videos (other than those taken by our photographers) are not permitted at any time. We reserve the right to use any individual or group photographs or videos of our students for press or promotional purposes, unless a parent/guardian have stated otherwise by email after making the booking and payment.

Data Protection (GDPR May 2018)

The information provided by you to us will only be used for the purposes of processing and administering the swim school. No information is sold or passed to any third parties without your explicit consent. The information you provide us (name, contact details, medical conditions etc.) is held securely and only accessible to those who need access to it.

Some information will be transferred to third parties to allow us to process your enrolments. This includes but is not limited, WorldPay and GoCardless who process our electronic payments, the organisations we work with to ensure compliance with all regional laws (e.g. our accountants, system administrators and HR providers). Only information which is relevant to each organisation will be transferred. All of these companies have been thoroughly vetted and are fully compliant with the regulations around the GDPR. The processing and storage of all data is entirely optional to all parents, guardians and swimmers however, without the consent for us to store and process the information we will be unable to accept you into our swim school.

Referral Program

How does the Referral Program work?

We are dedicated to delivering safe, progressive, and fun swimming lessons for your children. Your willingness to share your experience with others is greatly valued. In appreciation, we are pleased to announce the launch of our new referral program as a token of our gratitude.

Kindly request your friend (referee) to enter the "referred by" field with your name when completing our booking form. This step will enable us to recognise you and provide you with the complimentary lesson as a token of appreciation, subject to Terms & Conditions.

What are the Terms & Conditions for the Referral Program?

  • The referee is required to fill out the booking form, ensuring that the "referred by" field is populated with the name of the referrer.

  • The complimentary lesson is granted to the referrer in the subsequent term once the referee has completed full payment for a whole term. It is important to note that if the referee enrols during the middle of a term, a renewal for the following term is necessary to receive the free lesson.

  • There is no limit to the number of referrals you can make 

  • The referrer must be an existing customer to qualify for referral reward

Promotion Voucher Rewards

  • The voucher must be redeemed before the expiry date.

  • Rewards are subject to availability and do not allow for the selection of specific days and times.

  • Rewards are non-transferable for credits or monetary equivalents.

  • Redemption of rewards should take place in consecutive lessons.

  • Rewards are to be redeemed at the designated location unless an alternative location is approved by Gold Fins, subject to availability.

  • Rewards are intended for the same child aged 5 years and above.

  • Gold Fins reserves the right to retract the offer at their discretion.
